Welcome to RemakePic, an AI-powered product image remaking service for e-commerce sellers. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our service.

Service Description

RemakePic provides AI-powered image transformation services that help e-commerce sellers create unique product images. Our service includes:

• AI-driven product image remaking
• Batch image processing
• Image history and management
• Credit-based usage system

User Accounts

Account Creation

• You must create an account to use our services
• You must provide accurate and complete information
• You must be at least 18 years old to create an account

Account Security

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account

Acceptable Use

You May

• Upload product images you own or have rights to use
• Use generated images for your e-commerce business
• Download and use remade images for commercial purposes

You May Not

• Upload images containing illegal, harmful, or inappropriate content
• Upload images that infringe on third-party intellectual property rights
• Attempt to reverse-engineer our AI technology
• Use automated systems to abuse the service
• Resell or redistribute our service without authorization
• Use the service for any fraudulent or deceptive purposes

Prohibited Content

The following content is strictly prohibited anywhere in the service, including uploaded images, generated outputs, prompts, account names, and profile data:

• Sexual content, nudity, or NSFW material of any kind, including suggestive or partial nudity, fetish content, or sexualized depictions of any person.
• Any content involving minors in a sexual, suggestive, or exploitative context. We have zero tolerance for child sexual abuse material (CSAM) and will report violations to NCMEC and applicable authorities.
• Non-consensual intimate imagery, including deepfake nudes or revenge porn.
• Deepfakes, face-swaps, or impersonation of real, identifiable people (including celebrities, public figures, and politicians) without their explicit, documented consent.
• Graphic violence, gore, animal cruelty, self-harm, or suicide-related content.
• Hateful, harassing, or extremist content, including content targeting people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Content promoting illegal goods or services, including drugs, weapons, counterfeit products, or stolen goods.
• Copyrighted material, trademarks, or brand assets you do not own or have license to use.
• Personal identifying information (PII) of others without their consent.
• Malware, phishing, or other content designed to harm users or systems.

This list is not exhaustive. We reserve the right to refuse, remove, or report any content we judge harmful, abusive, or in violation of payment processor, hosting provider, or applicable law.

Image Content Guidelines

You represent and warrant that:

• You own or have the right to use all images you upload
• Your images do not infringe any third-party rights
• Your images do not contain illegal or harmful content
• Your images comply with applicable e-commerce platform policies

We reserve the right to refuse processing or remove any content that violates these guidelines.

Credits and Payments

Credit System

• Our service operates on a credit-based system
• Credits are required to process images
• Credit pricing is displayed on our pricing page

Purchases

• All credit purchases are processed through secure third-party payment providers
• Prices are listed in USD and may be subject to applicable taxes
• You agree to pay all charges associated with your purchases

Refund Policy

• Credits are generally non-refundable once purchased
• Unused credits do not expire
• If our service fails to deliver due to technical issues on our end, we may issue credit refunds at our discretion
• Refund requests must be submitted within 7 days of purchase

Intellectual Property

Our Rights

• RemakePic and its underlying technology are owned by us
• You may not copy, modify, or reverse-engineer our service
• Our trademarks and branding remain our exclusive property

Your Rights

• You retain ownership of your original uploaded images
• You own the rights to use generated/remade images
• Generated images may be used for personal and commercial purposes

Data and Privacy

• We process your images to provide our service
• Uploaded images are stored for 30 days and then automatically deleted

Service Availability

• We strive to maintain high service availability but do not guarantee uninterrupted access
• We may perform maintenance that temporarily affects service availability
• We reserve the right to modify or discontinue features with reasonable notice

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The service will meet your specific requirements
• Generated images will achieve particular results
• The service will be error-free or uninterrupted

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMAKEPIC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Damages exceeding the amount you paid us in the past 12 months

Indemnification

You agree to indemnify and hold harmless RemakePic from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to our service

Content Moderation and Enforcement

• We use automated content moderation (including AI classifiers) on uploaded images, generated outputs, and prompts to detect prohibited content. By using the service you consent to this scanning.
• We may also perform manual review of any content where automated moderation flags a possible violation or where abuse is reported.
• We retain moderation logs (image hashes, classifier scores, timestamps, and account identifiers) for safety, audit, and law-enforcement purposes for as long as legally required.
• Single-strike termination: Uploading or attempting to generate CSAM, non-consensual intimate imagery, or other content listed under "Prohibited Content" as zero-tolerance categories will result in immediate, permanent account termination without refund, and may be reported to NCMEC, payment processors, and law enforcement.
• Repeat violations: For other Prohibited Content categories, repeated violations (typically 3 strikes, but fewer at our discretion based on severity) will result in account suspension or termination without refund.
• No appeals for clear violations: Decisions involving CSAM, deepfake abuse, or similarly severe content are final.
• Abuse reports: To report abuse, suspected illegal content, or copyright infringement, email [email protected]. We typically respond within 48 hours.

Termination

• You may terminate your account at any time
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the service ceases immediately
• Unused credits are forfeited upon account termination for Terms violations
• Accounts terminated for violations of the Prohibited Content section are not eligible for any refund, regardless of remaining credits or recent purchases

Changes to Terms

• We may update these Terms from time to time
• We will notify you of significant changes via email or platform notification
• Continued use after changes constitutes acceptance of new Terms

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes will be resolved through binding arbitration or in courts of competent jurisdiction.
